The vast majority of the people sentenced in Victoria’s courts are sentenced in the Magistrates' Court (around 90% of all people sentenced). The Magistrates’ Court typically sentences between 80,000 and 100,000 people each year.

The number of people sentenced in the Magistrates’ Court fell from almost 100,000 people in 1996-97 to fewer than 73,000 people in 2000-01. After rising to just over 80,000 people in 2003-04, the number of people sentenced in the Magistrates’ Court remained fairly stable until 2007-08, when there was a sharp increase to more than 88,000 people. In 2008-09 there was a further increase, with 93,078 people being sentenced in the Magistrates’ Court. The number of people sentenced in this most recent year has begun to approach levels not seen since 1996-97 (97,359 people)
