New Discussion and Options Paper released
The Sentencing Advisory Council today released a discussion and options paper on parole revocation and certain types of confiscation orders, and their relevance to sentencing.
This project arose in response to a request from the Attorney-General for advice on the options for reform to address the consequences and implications of a number of Victorian Court of Appeal decisions. The decisions change the previous approach to sentencing in these circumstances and enable an offender to appeal against sentence if parole is revoked or certain forms of confiscation occur after sentence.
This raises questions of principle relating to the sentencing of offenders and has practical implications for the criminal justice system.
The paper discusses the issues raised by the decisions and sets out a series of questions. The paper then describes some possible options for reform for parole and confiscation respectively. Discussion points are listed under each option to assist with making a submission.
Submissions can be forwarded to the Council by mail, fax or email by Friday 17 July 2009.
