This project examines the sentencing options for offenders found guilty of driving while disqualified.
Examined the continued detention of offenders who have reached the end of their custodial sentence but who are considered to pose a continued and serious danger to the community.
Examined the feasibility of establishing a comprehensive database on homicide incidents and sentencing in Victoria.
Advised on the appropriate level of maximum penalty for the five existing Victorian preparatory offences.
Advised on the adequacy of the maximum penalty available for certain repeat offences against the Road Safety Act 1986.
Advised on the adequacy of the current maximum penalty of five years’ imprisonment for the offence of negligently causing serious injury.
Examined how provocation has featured in sentencing decisions for non-fatal offences in Victoria and also looking to interstate and international authorities to extract sentencing principles.
Advised on the merits of formalising a sentence indication scheme in Victorian Courts, and to investigate explicit sentence discounts.
Reviewing the use of suspended sentences and whether the operation of suspended sentences can be improved in any way.
