Sentencing for Offences Motivated by Hatred or Prejudice

In June 2009, the Attorney-General asked the Sentencing Advisory Council to provide advice on sentencing for offences motivated by hatred or prejudice.

Specifically, the Council was asked to consider how the Sentencing Act 1991 could be amended so that where an offence is motivated by hate or prejudice against a particular group, this motivation is taken into account as an aggravating circumstance at the time of sentencing.

The Council provided the advice to the Attorney-General in July 2009. A copy of the advice is available on this website.
