Guilty Pleas and Section 6AAA of the Sentencing Act 1991 (Vic)

In October 2014, the Council began a project examining guilty pleas and the application of section 6AAA of the Sentencing Act 1991 (Vic) in the higher courts.

The project examined cases sentenced in the higher courts from 1 July 2009 to 30 June 2014, resulting in the report Guilty Pleas in the Higher Courts: Rates, Timing and Discounts, which was released on 11 August 2015. The report provides information about:

  • the rate and timing of guilty pleas in the higher courts
  • the level of compliance with section 6AAA of the Sentencing Act 1991 (Vic)
  • the level of sentencing discounts (identified from the 6AAA statements).

This project builds on the Council's previous work, including two reports: Sentence Indication and Specified Sentence Discounts: Final Report from September 2007 and Sentence Indication: A Report on the Pilot Scheme from February 2010.
