Provocation in Sentencing examines how provocation has featured in sentencing decisions for non-fatal offences in Victoria, and also looks to interstate and international authorities to extract sentencing principles. The report suggests an approach to considering provocation in sentencing that seeks to avoid the problems and flaws of the pre-existing law.
The Council published the first edition of the report in February 2008. The second edition incorporates a comprehensive index and an enlarged fold-out of the report's key graph.
