Youth diversion is an option for children under the Children’s Court Youth Diversion Service.
Youth diversion aims to divert children from the justice system. Youth diversion is suitable for children with limited or no criminal history. The child must accept responsibility for the offending, and both the prosecution and child must consent to the diversion.
The Children’s Court can adjourn (postpone) proceedings for up to 6 months while the child completes a diversion plan.
Conditions of Youth Diversion
The diversion plan generally involves one or more conditions. The conditions could include the child writing a letter of apology to the victim, or they might help with the child’s education (such as supporting the child to improve their attendance at school).
If the child successfully completes their diversion plan, the Children’s Court will discharge the child with no finding of guilt or a conviction.
