Sentencing for Offences Motivated by Hatred or Prejudice

In 2009, the then Attorney-General asked the Council to provide advice on sentencing for offences motivated by hatred or prejudice.

The Council was asked to consider how the Sentencing Act 1991 (Vic) could be amended so that where an offence is motivated by hate or prejudice against a particular group, this motivation is taken into account as an aggravating circumstance at the time of sentencing.

Sentencing for Offences Motivated by Hatred or Prejudice represents the Council's advice on this issue.
